Terms of service

1) OVERVIEW

This website is operated by Tejas Beads (“Tejas Beads,” “we,” “us,” “our”). By visiting the site and/or purchasing from us (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and any policies referenced or linked here (collectively, the “Agreement”). If you do not agree, do not access or use the Service. We may update these Terms from time to time by posting a revised version on this page. Your continued use of the Service after posting constitutes acceptance of the changes.

Platform Notice: Our store is hosted on Shopify Inc., which provides the online e-commerce platform enabling us to sell our products and services to you. These Terms govern purchases made through the Service; purchases made in person at our retail location are governed by the policies posted or provided at the store.

2) ELIGIBILITY & ACCOUNT RESPONSIBILITIES

You represent that you are at least the age of majority in your state or province of residence, or you have consent from your legal guardian. You agree to provide current, complete, and accurate purchase and account information and to promptly update it as needed. We reserve the right to refuse Service to anyone, for any reason, at any time, and to limit or cancel quantities purchased per person, per household, per order, or per address. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account, and you agree to notify us promptly of any unauthorized use of your account.

3) ORDERS, PRICING & AVAILABILITY

All products and prices are subject to change without notice. We may discontinue products at any time. We may limit quantities and reject or cancel orders at our discretion (for example, suspected reseller orders). If we change or cancel an order, we may attempt to notify you using the email, billing address, or phone number provided at checkout. Orders are offers to purchase and subject to our acceptance. We may cancel orders affected by obvious pricing or listing errors, even after submission; any amounts charged will be refunded. Sales tax, shipping, duties, and other charges (if any) will be shown or applied as required by law.

3.1 Promotions & Coupons. Promotions are limited-time and subject to change without notice. Unless stated otherwise, promotions cannot be applied retroactively, cannot be combined, and exclude gift cards, taxes, and shipping.

3.2 Personal Use & Resale. Retail purchases are intended for personal or studio use. We may refuse, limit, or cancel orders we believe are for resale or distribution. Resellers must obtain a wholesale account and agree to our Wholesale Terms.

3.3 Currency & Exchange Rates. All prices and charges are in U.S. Dollars (USD). Your bank may apply currency conversion or international transaction fees. Refunds are issued in USD for the original charged amount; any currency exchange differences or bank fees are your responsibility.

3.4 Gift Cards & Store Credit. Gift cards and store credits are issued in USD, do not expire, and carry no fees. Where required by law, unclaimed balances may be escheated (remitted) to the appropriate state after a statutory dormancy period; after remittance the card/credit may no longer be redeemable. Promotional vouchers/discount codes may have stated expiration dates and additional terms.

3.5 Order Cancellation. You may request cancellation of an order at no charge at any time before we begin processing it. Orders cancelled after processing or picking has begun, but before shipment, may incur the restocking fee described in Section 6.5 and any payment processing fees not refunded to us by the payment processor. Once an order has been fulfilled (shipped), it can no longer be cancelled and is instead subject to our Returns & Refunds policy (Section 6) and, where applicable, Section 27. For consumers covered by Section 27, a cancellation request submitted before fulfillment and a return request submitted after fulfillment each constitute an unequivocal statement exercising the statutory right of withdrawal described in Section 27.2, and no cancellation fee or deduction applies to such a statutory withdrawal.

4) PRODUCT INFORMATION & ACCURACY

4.1 Display & Variation. We endeavor to display product information (including colors and images) as accurately as possible; however, device displays and natural variations—especially for gemstones—may cause differences.

4.2 Natural Materials & Expected Imperfections. As many products are natural or hand-finished, size, color, tone, pattern, hole diameter, hole placement, bead count per strand, strand length, and weight may vary. Because each strand contains many individual beads, some degree of natural imperfection—including minor chips, chipped or uneven drill holes, surface marks, and inclusions—is inherent to natural stone and is to be expected. These variations and minor imperfections are normal characteristics of natural materials and are not considered defects.

4.3 Gemstone Nomenclature, Treatments & Trade Names. While we strive for scientific accuracy, some stones may be described using commonly accepted industry trade names rather than strict mineralogical species or localities. Unless specifically stated as “untreated,” gemstones may have common industry treatments (e.g., stabilization, dyeing, heat, resin/wax, impregnation, reconstitution, plating). Descriptions are based on supplier documentation and industry standards and are not laboratory certifications. If you need clarification on mineral species, treatments, or origin for a specific product, please contact us before purchasing.

4.4 Updates. We may correct or update product information at any time without prior notice, including after an order is submitted.

4.5 Safety Notice. Safety: Small parts—not for children under 3. Intended for jewelry/craft use age 14+.

4.6 Size Tolerances. Bead sizes are approximate and measured to the nearest standard size, rounding down at the 0.5mm mark (for example, a bead measuring 3.0mm–3.49mm is labeled 3mm). Size variations of up to 0.5mm on smaller beads and up to 1mm on larger beads are normal and are not considered defects. Variation in size may be more visually apparent on smaller beads.

4.7 Unit of Sale. Unless otherwise stated, beads are sold by the single strand, with one (1) strand per unit quantity ordered. Bead count and strand length per strand are approximate, as beads are strung by size rather than by count.

5) SHIPPING, DELIVERY & RISK OF LOSS

5.1 Delivery Confirmation. Carrier tracking showing “Delivered” to the shipping address and/or a captured signature at the address (including by any person at that address or an authorized agent) constitutes delivery and completes our delivery obligation.

5.2 Shipping Insurance. We offer optional shipping insurance as an add-on at checkout. This coverage must be selected and purchased at the time of order and cannot be added after checkout. Shipping insurance is provided by a third-party insurer (ShipWorks/InsureShip) and is subject to the insurer’s terms, conditions, limitations, and exclusions. By purchasing this option, you agree that any claims, coverage determinations, and payouts are handled solely by the insurance provider. Shipping insurance does not alter or override delivery confirmation. We do not guarantee approval of any claim and are not liable for loss or damage in transit beyond any applicable carrier liability or approved insurance coverage. Orders placed without this add-on ship without third-party shipping insurance.

5.3 Signature Requirements. For high-value orders, we may require a signature. If the carrier records a signature at the address, the order is deemed delivered.

5.4 Post-Delivery Loss/Theft. Loss, theft, or damage after the carrier marks the package delivered is your responsibility. If you suspect theft, file a police report and a carrier/mail-theft report and share the report numbers with us.

5.5 Multiple Packages & Partial Delivery. Orders may ship in multiple boxes that can arrive on different days. A partial delivery does not indicate a missing shipment within three (3) business days of the first delivery scan.

5.6 Address Accuracy. You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, misdelivery, or non-delivery due to address errors. Additional re-shipping fees may apply.

5.7 Delivery Inquiries. If tracking shows delivered but you cannot locate the package, notify us within three (3) calendar days of the delivery scan. We will assist with a carrier inquiry as a courtesy, but replacement or refund is not guaranteed where delivery is confirmed.

5.8 International Orders (Importer of Record). For international shipments, unless the shipping method selected at checkout is expressly designated as Delivered Duty Paid (DDP), you are the Importer of Record and are responsible for all duties, taxes, and customs fees. Transit times may be extended by customs inspection. Refused or unclaimed international packages may be returned or destroyed by the carrier; outbound and return shipping charges, customs fees, and any carrier-assessed losses may be deducted from any refund, if applicable. We are not responsible for delays once the package is with customs or the carrier. For shipments sent via a DDP method, import duties and taxes remitted on your behalf are non-refundable in the event of a return, except (a) where a statutory right of withdrawal applies (see Section 27), or (b) where the return results from our error or a product defect.

5.9 Address Corrections & Re-Ship Fees. If a shipment is returned or requires rerouting due to address errors or omissions provided at checkout, you may be responsible for carrier correction fees and additional shipping charges.

5.10 Risk Screening & ID Verification. We may hold or cancel orders for fraud screening and may require photo ID and/or proof of address for high-value or mismatched orders. We ship only to the address confirmed at checkout unless we agree otherwise in writing.

5.11 Export Controls & Sanctions. You represent and warrant that you are not located in, and will not ship, transfer, or re-export products to, any country or region subject to a U.S. government embargo, and that you are not identified on any U.S. government denied-party or restricted-party list. You agree to comply with all applicable U.S. export control and sanctions laws and regulations. We may cancel, without liability, any order we believe may violate such laws.

6) RETURNS & REFUNDS

Please review this section carefully before initiating a return. If you are a consumer habitually resident in the European Union, the European Economic Area, or the United Kingdom, the statutory rights described in Section 27 apply to you in addition to this Section 6, and prevail over this Section 6 to the extent of any conflict.

6.1 RMA Required. All returns require a Return Authorization (RMA) initiated through your online account. Unauthorized returns may be refused or assessed additional handling. This Section 6.1 does not apply to the exercise of a statutory right of withdrawal under Section 27.

6.2 Return Window. You must request Return Authorization within thirty (30) days of the date of delivery (for orders delivered in multiple shipments, the date of delivery of the last item in the order), and, once approved, the return must be postmarked within five (5) business days thereafter. Returns shipped outside these timelines may be refused or returned to sender at your expense. Returns accepted outside these timelines as a courtesy are at our sole discretion and do not waive this policy for any other order.

6.3 Condition. Items must be returned in original, unused, and resalable condition with original packaging. Products returned used, altered, damaged, or otherwise not in resalable condition are not eligible for refund.

6.4 Packaging & Risk. You are responsible for proper packaging and the safe return of the goods. We strongly recommend insured, trackable shipping. Risk of loss for return shipments remains with you until received and inspected by us.

6.5 Restocking & Non-Refundable Costs. (a) Restocking Fee: Returns may be subject to a restocking fee of up to twenty percent (20%) of the merchandise value of the returned items, assessed based on the quantity of items returned, the inspection and restocking effort required, and the customer’s order and return history. (b) Outbound Shipping: Outbound shipping costs are non-refundable. If a return causes an order to fall below any free-shipping threshold, our actual outbound shipping cost will be deducted from the refund. (c) High-Cost/Upgraded Shipping: If your original order size/weight triggered upgraded, oversize, or multi-carton shipping, and a majority of items are returned, we may deduct our actual outbound shipping expense to recoup those costs. (d) Payment Processing Fees: Any third-party payment processing fees we do not recover upon refund (e.g., credit card/processor fees) are non-refundable and may be deducted from the refund. (e) DDP Duties & Taxes: For international orders shipped via a DDP method, import duties and taxes remitted on your behalf are non-refundable as provided in Section 5.8. None of the deductions in this Section 6.5 applies where the return results from our error or a verified product defect. This Section 6.5 does not apply to the exercise of a statutory right of withdrawal under Section 27.

6.6 Inspection & Adjustments. We document the condition of returned items on receipt (including photos). If a return includes damaged or non-resalable items (including damage due to poor packaging or customer alterations), we will notify you and adjust the refund accordingly or, at our discretion, offer to return such items to you at your expense.

6.7 Refund Method & Timing. Approved refunds are issued to the original payment method (or store credit where applicable) within ten (10) business days of our receipt and inspection of the return. Please allow additional time for your financial institution to process and post the refund; if more than fifteen (15) business days have passed since your refund was approved, contact us at sales@tejasbeads.com.

6.8 Eligibility of Items. No product category is excluded from return under this policy. Any item purchased online may be returned provided it satisfies the condition requirements of Section 6.3; items that have been used, cut, restrung, altered, or otherwise rendered non-resalable are not eligible for refund. Gift cards are non-returnable and non-refundable; unredeemed balances do not expire (Section 3.4).

6.9 Returns Abuse & Fraud. We may refuse service, restrict returns, or close accounts, in our discretion, where we identify excessive returns, return abuse, or suspected fraud.

6.10 Prepaid Return Labels. If we provide a prepaid return label as a courtesy outside policy (other than for a return resulting from our error or a verified defect), the label cost may be deducted from any refund. Labels may be used only for the authorized items and timeframe; misuse may result in additional charges or refusal of the return.

7) NON-DELIVERY, SHORTAGE, OR DAMAGE CLAIMS

7.1 Report Deadline. Any claim for non-delivery, missing items, or transit damage must be submitted within three (3) calendar days of the carrier’s delivery scan and include your order number and photos (where applicable).

7.2 Evidence Controls. Where carrier records show delivery (and, if applicable, signature), such records will be used to evaluate claims.

7.3 Time Limit to Bring Claims. To the fullest extent permitted by law, any claim related to the products or Service must be filed within one (1) year after the cause of action accrues, or be permanently barred.

7.4 Statutory Rights Preserved. Sections 7.1 and 7.3 do not limit any non-waivable statutory rights or claim periods available to consumers under applicable law, including the legal guarantees described in Section 27.5.

8) PROHIBITED USES

You agree not to use the site or its content for any unlawful or prohibited purpose, including but not limited to: violating laws or third-party rights; transmitting malware; scraping; submitting false or misleading information; harassing or discriminating; or interfering with the Service’s security or operation. We may terminate or restrict access for violations.

9) OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Third-party links may lead to sites not affiliated with us; we are not responsible for their content, policies, or transactions.

9.1 Installment/Financing Providers. If you pay using a third-party financing option (e.g., Shop Pay Installments, Affirm, Afterpay), your financing agreement is between you and that provider. Our Returns & Refunds policy applies to your purchase. Interest or fees charged by the provider are not refunded by us.

10) USER CONTENT (COMMENTS, REVIEWS, SUBMISSIONS)

By submitting content (e.g., reviews, photos, suggestions), you grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, reproduce, publish, and display such content in any media, without compensation. You represent that you have the rights to grant this license and that your content does not violate law or third-party rights. We may monitor, edit, or remove content in our discretion.

11) INTELLECTUAL PROPERTY

11.1 Ownership & Trademarks. All content on the site and Service—including product photographs and images, product descriptions, text, graphics, logos, page layouts, and the selection and arrangement thereof—is owned by or licensed to Tejas Beads and is protected by United States and international copyright, trademark, trade dress, and other intellectual-property laws. TEJAS BEADS® is a federally registered trademark (U.S. Reg. No. 6,268,698); unauthorized use of the mark is prohibited. Except as necessary to browse the site and make purchases for your own use, no content may be copied, reproduced, republished, uploaded, posted, scraped, transmitted, or distributed in any way without our prior written permission. No right, title, interest, or license in or to any content or mark is transferred to you under these Terms.

11.2 Copyright Complaints (DMCA). We respect the intellectual-property rights of others and expect users of the Service to do the same. If you believe that material available on the Service infringes your copyright, you may send a notification to our copyright contact at sales@tejasbeads.com (subject line: “Copyright Notice”) containing the information required by 17 U.S.C. § 512(c)(3), including: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and information reasonably sufficient to locate it; (c) your name, address, telephone number, and email address; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in the notification is accurate and that you are the owner or authorized to act on behalf of the owner; and (f) your physical or electronic signature. We may remove or disable access to material claimed to be infringing and may terminate the accounts of repeat infringers.

12) PRIVACY

Your submission of personal information through the store is governed by our Privacy Policy (incorporated by reference).

13) ERRORS, INACCURACIES & OMISSIONS

From time to time there may be information on the site or Service that contains errors or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct and update such information without prior notice, including after an order is submitted.

14) DISCLAIMERS; LIMITATION OF LIABILITY

The Service and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. To the maximum extent permitted by law, Tejas Beads and its officers, employees, affiliates, agents, contractors, and suppliers are not liable for any indirect, incidental, special, consequential, punitive, or similar damages (including lost profits, revenue, data, replacement costs) arising from your use of the Service or products, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility. In any event, our maximum aggregate liability for any claim relating to the products or Service shall not exceed the amount you actually paid to us for the product(s) giving rise to the claim. In jurisdictions that do not allow such exclusions or limitations, our liability shall be limited to the maximum extent permitted by law. Nothing in this Section 14 excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or the statutory guarantees of conformity described in Section 27.5.

15) INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Tejas Beads and its affiliates, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of this Agreement or violation of law or third-party rights.

16) SEVERABILITY

If any provision of this Agreement is unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed without affecting the validity of the remaining provisions.

17) TERMINATION

These Terms remain effective unless and until terminated by either party. You may terminate by ceasing use of the site and notifying us. If we believe you have violated this Agreement, we may terminate or suspend access without notice. Obligations and liabilities incurred prior to termination survive termination.

18) ENTIRE AGREEMENT; NO WAIVER

These Terms and any policies or operating rules posted on the site constitute the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous communications. Our failure to exercise or enforce any right shall not constitute a waiver of such right.

19) GOVERNING LAW; VENUE

To the fullest extent permitted by law, these Terms and any dispute or claim arising out of or relating to them, the Service, or any purchase are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws rules. You and Tejas Beads agree that any such dispute shall be brought exclusively in (a) the state courts sitting in Hampshire County, Massachusetts (including the District Court and its Small Claims session), or (b) the United States District Court for the District of Massachusetts, Western Division (Springfield). Each party irrevocably consents to personal jurisdiction and venue in those courts and waives any objection based on improper venue or forum non conveniens. Nothing in this Section limits any non-waivable consumer rights under applicable law. If you are a consumer habitually resident in the European Union, the European Economic Area, or the United Kingdom, this Section applies only to the extent permitted by the law of your country of habitual residence, and Section 27.6 additionally applies.

20) CHARGEBACKS & DISPUTE RESOLUTION (NOTICE)

We stand behind our policies and may contest chargebacks where delivery is confirmed or where returns did not comply with this Agreement. Evidence may include carrier tracking and Proof of Delivery (POD) with signature, labels, invoices, warehouse scan logs, photos, and communications. Initiating a chargeback during an active customer-service resolution may delay resolution; please contact us first.

20.1 Class Action & Jury Trial Waiver. To the fullest extent permitted by law, disputes shall be resolved only on an individual basis and not as a plaintiff or class member in any purported class or representative action. You and Tejas Beads waive any right to a jury trial. This Section 20.1 does not apply where prohibited by applicable law, including with respect to consumers habitually resident in the European Union, the European Economic Area, or the United Kingdom to the extent such waivers are not permitted by the mandatory law of the consumer’s country of habitual residence.

21) MEDICAL INFORMATION DISCLAIMER

Any information on this website related to wellness, metaphysical properties, or similar topics is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek advice from a qualified healthcare provider and never disregard professional advice because of something you read on this site.

22) PRODUCT SAFETY & AGE WARNING

Our products may contain small parts and are not toys. They present a choking hazard and are not intended for children under 3 years old. Products are intended for jewelry-making and craft use by individuals age 14+ or by adults. Keep all small parts out of reach of children.

23) CALIFORNIA PROPOSITION 65 NOTICE

Some products can expose you to chemicals including nickel, lead, or cadmium, which are known to the State of California to cause cancer and birth defects or other reproductive harm. For more information, visit www.P65Warnings.ca.gov. If you have questions about specific items, contact us before purchasing.

24) FORCE MAJEURE

We are not liable for delay or failure to perform due to events beyond our reasonable control, including acts of God, weather, epidemic, labor disputes, carrier failures, embargoes, governmental actions, or interruptions of transportation, utilities, or supply.

25) ELECTRONIC COMMUNICATIONS

By using the Service or sending us emails/messages, you consent to receive electronic communications from us and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

25.1 Text Messaging Terms (TCPA). With your consent, we may send you marketing and transactional text messages. Message & data rates may apply. Message frequency varies. Text STOP to opt out and HELP for help. Consent is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for details.

26) MISCELLANEOUS

26.1 Assignment. We may assign or transfer these Terms, in whole or in part, and any of our rights and obligations hereunder, without restriction. You may not assign your rights or obligations under these Terms without our prior written consent; any attempted assignment in violation of this Section is void.

26.2 No Third-Party Beneficiaries. These Terms do not, and are not intended to, confer any rights or remedies upon any person other than you and Tejas Beads.

26.3 Headings. Section headings are for convenience of reference only and shall not affect the interpretation of these Terms.

26.4 Notices. We may provide notices to you by email to the address associated with your order or account, by posting on the site, or by other reasonable means. Notices to us should be sent to sales@tejasbeads.com.

27) ADDITIONAL TERMS FOR CONSUMERS IN THE EUROPEAN UNION, EUROPEAN ECONOMIC AREA & UNITED KINGDOM

27.1 Scope & Precedence. This Section 27 applies only if you are a natural person acting for purposes outside your trade, business, craft, or profession (a “consumer”) and you are habitually resident in a member state of the European Union or the European Economic Area, or in the United Kingdom. Where this Section 27 conflicts with any other provision of these Terms, this Section 27 prevails for such consumers. Nothing in these Terms excludes, limits, or restricts any rights or remedies you have under mandatory provisions of the law of your country of habitual residence, including Directive 2011/83/EU (Consumer Rights Directive), Directive (EU) 2019/771 (Sale of Goods Directive), and, in the United Kingdom, the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, in each case as implemented and amended.

27.2 Right of Withdrawal (Right to Cancel). You have the right to withdraw from your purchase contract within fourteen (14) days without giving any reason. The withdrawal period expires fourteen (14) days after the day on which you, or a third party other than the carrier indicated by you, acquires physical possession of the goods or, in the case of an order for multiple goods delivered separately, of the last good. To exercise the right of withdrawal, you must inform us (Tejas Beads, sales@tejasbeads.com) of your decision to withdraw by an unequivocal statement (for example, an email or a letter sent by post). You may use the model withdrawal form set out in Annex A, but it is not obligatory. Use of our Return Authorization (RMA) process is available as a convenience but is not required to exercise this statutory right. A cancellation request submitted through your account before fulfillment, or a return request submitted after fulfillment, likewise constitutes an unequivocal statement of withdrawal. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

27.3 Effects of Withdrawal. If you withdraw from the contract, we shall reimburse all payments received from you, including the costs of standard outbound delivery (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen (14) days from the day on which we are informed of your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. No restocking fee applies to a statutory withdrawal under this Section 27. For shipments sent Delivered Duty Paid (DDP), amounts you paid to us in respect of import duties and taxes form part of the payments reimbursed under this Section 27.3, notwithstanding Sections 5.8 and 6.5. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods without undue delay and in any event not later than fourteen (14) days from the day on which you communicate your withdrawal to us; the deadline is met if you send back the goods before the fourteen-day period has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

27.4 Exceptions to the Right of Withdrawal. In accordance with applicable law, the right of withdrawal does not apply to contracts for the supply of goods made to your specifications or clearly personalized, including custom or altered items and strands cut to customer-specified lengths.

27.5 Legal Guarantee of Conformity. As a consumer covered by this Section 27, you benefit from a legal guarantee of conformity for goods under the law of your country of habitual residence (in EU/EEA member states, generally a minimum of two (2) years from delivery; in the United Kingdom, as provided by the Consumer Rights Act 2015). Under that guarantee, we are liable for any lack of conformity existing at the time of delivery that becomes apparent within the applicable statutory period, and you may be entitled to remedies including repair, replacement, price reduction, or termination of the contract, as provided by applicable law. The reporting deadlines in Section 7.1, the claim limitation period in Section 7.3, the disclaimers and limitations in Section 14, and the condition requirements in Section 6 do not limit this legal guarantee. Section 4.2 describes normal characteristics of natural stone products that form part of the agreed description of the goods and do not constitute a lack of conformity.

27.6 Governing Law & Venue for Consumers. Notwithstanding Section 19, if you are a consumer covered by this Section 27, you benefit from the protection of the mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in the courts of that country. Nothing in Section 19 or Section 20.1 deprives you of such protection or of the right to bring or defend proceedings in your local courts where applicable law so provides.

27.7 Contract Confirmation on a Durable Medium. Confirmation of your order, together with these Terms and the information concerning the right of withdrawal, is provided to you on a durable medium by email following the placement of your order.

27.8 Relationship to Voluntary Return Policy. The return policy in Section 6 is a voluntary commercial policy offered in addition to, and does not replace or limit, your statutory rights under this Section 27. Where the two overlap, you may rely on whichever is more favorable to you.
